WhiskyFest Terms and Conditions

Terms and Conditions of the Agreement between Festival Sponsor and M. Shanken Communications, Inc. dba Whisky Advocate.


PAYMENT TERMS: Due upon receipt.

CONDITIONS: Festival Sponsor agrees to participate with M. Shanken Communications, Inc. dba Whisky Advocate during WhiskyFest on November 14, 2025 according to the following conditions:

  • Festival Sponsor states that it has the authority to enter into this agreement for festival sponsorship and agrees to assume liability for its actions or its representatives actions during WhiskyFest, as well as any claim arising there-from made against Whisky Advocate.
  • Pouring Guidelines: You may pour an unlimited number of expressions at your WhiskyFest booth, but only one brand is permitted per booth.
  • WhiskyFest partners with Premier Exposition Services for all freight handling, display labor, and exhibitor services. Rates apply, and are available upon request.
  • Festival Sponsor agrees to provide product for this event, in accordance with applicable laws and regulations. Festival Sponsor also agrees to not serve alcoholic beverages to anyone appearing intoxicated or under the legal drinking age.
  • Festival Sponsor agrees to indemnify and hold harmless Whisky Advocate, its owners, officers, servants and employees from all costs, including reasonable attorneys' fees of Whisky Advocate caused by its actions.
  • The Festival Sponsor indemnifies Whisky Advocate against all claims, damages or liability whatsoever arising out of or in any way caused by or connected to this agreement.
  • Whisky Advocate reserves the right to cancel the contract upon default of payment or breach of any provision herein where such breach is incapable of remedy. The Festival Sponsor agrees to indemnify, save, and hold harmless Whisky Advocate against all losses and expenses incurred in the collection of any delinquent balance including reasonable attorneys fees.
  • All conditions set forth in this contract have been read and understood by both parties. All conditions are set forth in this, the entire agreement, between the parties hereto, and no representation or premise not specifically set forth herein shall affect the duties or liabilities of either party hereunder.

DISPLAYS & DECORATIONS: Any property of the Festival Sponsor or Sponsor’s representatives brought to the hotel(s) listed above shall be the sole risk of the Festival Sponsor and Whisky Advocate shall not be liable for any loss or damage to any such property for any reason. Festival Sponsor assumes responsibility for obtaining proper insurance, and assumes liability for losses, damages, and claims arising out of injury or damage to displays, equipment, and other property brought on the premises of the hotel(s) and shall indemnify and hold Whisky Advocate and the hotel(s), its servants and employees harmless from any and all such losses, damages and claims, except to the extent caused by the negligent acts or omissions of the Whisky Advocate. Prior to the commencement of the event, Exhibitor shall submit a Certificate(s) of Insurance from a reputable insurance carrier, rated "A" or better by AM Best, naming M. Shanken Communications, Inc., its subsidiaries and affiliates, etal as additional insured. Said policies must remain in full force and effect throughout the event.

Requirements - Minimum Limits:

  1. Comprehensive General Liability Each Occurrence $1,000,000
  2. Damage to Rented Premises (each occurrence) $100,000
  3. Med Exp $5,000
  4. Personal & Adv Injury $1,000,000
  5. General Aggregate $2,000,000
  6. Products-Completed/ Op Agg $2,000,000
  7. Automobile Liability $1,000,000
  8. Umbrella Liability
    • Per Occurrence $5,000,000
    • Aggregate $5,000,000
  9. Workers Compensation with a minimum limit of $1,000,000
  10. Liquor Liability
    • $2,000,000 Aggregate Limit
    • $1,000,000 Occurrence Limit

Certificates must note the event name, venue, and date(s) of the event(s), along with the following:

M. Shanken Communications, Inc., its affiliated and/or subsidiary companies are included as an Additional Insured with respects to the job performed on the General Liability, Auto Liability and Umbrella Liability. General Liability coverage is primary and non-contributory basis with completed operations for the Additional Insured. Waiver of Subrogation is applicable to the Additional Insured with respect to the General Liability, Auto liability and Umbrella Liability.

BOOTH PLACEMENT WILL BE AT THE DISCRETION OF WHISKY ADVOCATE.
